SUHARA ("SUHARA", "we", "us", "our") is a sole proprietorship operating the website suharawears.com (the "Site"). This Policy explains how we collect, use, store, share, and protect your personal data as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 ("DPDPA") and the Information Technology Act, 2000, and describes your rights as a Data Principal. By using the Site, you agree to the practices described here.

2. Personal Data We Collect

Identity & contact data: name, email, phone number, shipping and billing address
Order & transaction data: items purchased, order value, order history (payment instrument details such as full card numbers are never collected or stored by us — handled directly by our RBI-authorised payment gateway)
Technical data: IP address, browser/device type, approximate location, pages visited, referring URL — via cookies and analytics
Correspondence: messages sent via email, Instagram, WhatsApp, or the Site's contact form
Account data: if you create an account, your login credentials (passwords stored in encrypted/hashed form only)

3. Purpose & Legal Basis for Processing

We process your data on the basis of consent (given at checkout or account creation) and, where applicable, for performing a contract with you:

Processing, fulfilling, and shipping your orders
Customer support, order updates, and dispute/return handling
Transactional emails/SMS (always sent) and marketing communications (only with opt-in consent, withdrawable anytime)

4. Consent & Withdrawal

You may withdraw consent at any time by emailing info@suharawears.com. Withdrawal doesn't affect processing already carried out, and may affect our ability to fulfil an order already placed.

5. Sharing & Disclosure

We do not sell or rent your personal data. We share data only with:

Payment gateway providers, to process payments securely
Courier/logistics partners, to deliver your order (name, address, phone number only)
Analytics and marketing tool providers, bound by contract to use data only for the stated purpose
Government or regulatory authorities, where required by law, court order, or to protect our legal rights

We do not knowingly transfer personal data outside India except where a listed third-party provider processes data on servers located outside India as part of standard infrastructure (e.g., cloud hosting); such providers are contractually bound to maintain equivalent data protection standards.

7. Data Retention

Order and transaction data is retained as long as required under Indian tax/consumer protection law (currently up to 8 years for accounting records). Account/marketing data is retained until you request deletion or withdraw consent. We also retain records of orders, returns, refunds, and communications for as long as necessary to establish, exercise, or defend legal claims. Data no longer needed is securely deleted or anonymised.

8. Data Security

We use reasonable technical and organisational measures — SSL/TLS encryption, restricted access, secure hosting — to protect your data. No online system is 100% secure; in the event of a breach likely to affect you, we will notify you and the Data Protection Board of India as required under the DPDPA.

9. Your Rights as a Data Principal

Under the DPDPA, you have the right to:

Access a summary of the personal data we hold and how it's processed
Request correction or completion of inaccurate/incomplete data
Request erasure, unless we're required to retain it by law
Withdraw consent at any time
Nominate another individual to exercise these rights on your behalf in the event of death or incapacity
File a grievance with us, and if unresolved, escalate to the Data Protection Board of India

To exercise any right, email info@suharawears.com with subject "Data Rights Request." We acknowledge within 7 days and resolve within 30 days. We may require reasonable proof of identity before acting on a request.

11. Children's Data

Our Site is not directed at, and we do not knowingly collect data from, individuals under 18 without verifiable parent/guardian consent (DPDPA Section 9). If we learn we've inadvertently collected a minor's data without such consent, we will delete it promptly.

12. Electronic Communications Consent

By using the Site, you consent to receive communications from us electronically (email, SMS, WhatsApp). You agree that electronic agreements, notices, disclosures, and other communications satisfy any legal requirement that such communications be in writing.

13. Changes to This Policy

We may update this Policy to reflect changes in law or practice. Material changes will be notified via the Site or email before taking effect. Continued use after changes take effect constitutes acceptance.
