As required under the Consumer Protection (E-Commerce) Rules, 2020, this business information, along with return/refund/exchange and grievance redressal details, is disclosed here and remains accessible before you complete a purchase.

2. Eligibility

You must be at least 18 years old and capable of entering a binding contract under the Indian Contract Act, 1872. If under 18, you may use the Site only with a parent/guardian's involvement, who agrees to these Terms on your behalf.

3. Account, Password & Security

If you create an account, you're responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorised use or security breach, and to log out at the end of each session. SUHARA is not liable for loss or damage arising from your failure to keep your account secure. Orders placed through your account are deemed placed by you.

4. Products, Pricing & Availability

Prices are in INR (₹), inclusive of applicable GST unless stated otherwise at checkout; additional shipping/handling charges are disclosed before payment confirmation
We make reasonable efforts to keep descriptions, images, and prices accurate; if a pricing/listing error is discovered after you order, we will contact you before processing and you may cancel for a full refund. We are not obliged to fulfil an order at a manifestly incorrect price (e.g., an obvious misprint), and may cancel such orders with a full refund
Colours, prints, and embroidery may vary slightly from images due to screen calibration, lighting, and the handcrafted/dyeing nature of the fabric — this is not a defect and is not grounds for a defect claim (see our Return, Exchange & Refund Policy)
Stock is not reserved until payment is confirmed; in rare cases of a genuine stock discrepancy after payment, we offer a full refund or a substitute of equal value, at your choice

5. Orders & Payment

An order is confirmed only after successful payment authorisation or, for COD, after we send an order confirmation (which may follow telephonic/WhatsApp confirmation)
Payment via UPI, debit/credit cards, net banking, and other methods shown at checkout, processed through an RBI-authorised third-party gateway; SUHARA does not store your full card/bank credentials
We reserve the right to cancel or refuse any order — before dispatch — for suspected fraud, abuse of a promotional offer, resale/bulk-buying without arrangement, pricing errors, or stock unavailability, with a full refund of any amount paid
Promotional codes: one code per order unless stated otherwise; codes have no cash value, cannot be applied retrospectively, and may be withdrawn at any time for future orders. Orders that game promotional mechanics (split orders, multiple accounts, coupon stacking exploits) may be cancelled

6. Returns, Exchanges & Shipping

Our Return, Exchange & Refund Policy and Shipping Policy are incorporated into these Terms by reference and apply to every order, including their fair-use provisions.

7. Intellectual Property

All content on the Site — the SUHARA name and logo, product designs, photography, text, graphics — is owned by or licensed to SUHARA and protected under Indian copyright, trademark, and design law. You may not reproduce, distribute, or create derivative works without our prior written consent. Unauthorised use may result in legal action.

8. User Conduct, Content & Feedback

You agree and undertake, when using the Site, not to:

Defame, abuse, harass, stalk, threaten, or violate the legal rights of others
Publish or upload profane, defamatory, infringing, obscene, or unlawful material
Upload files containing software/material protected by IP law without necessary rights/consent
Upload or distribute viruses, corrupted files, or malicious software
Run surveys, contests, pyramid schemes, or chain letters through the Site
Falsify or delete author attributions or proprietary notices on uploaded material
Violate any applicable law or regulation, in India or elsewhere
Misuse the Site, attempt unauthorised access to our systems, or scrape content

If you submit reviews, photos, or comments ("User Content"), you grant SUHARA a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it for marketing purposes, unless you notify us otherwise in writing. You're solely responsible for ensuring User Content doesn't infringe any third party's rights. We may remove User Content at our discretion.

Feedback: any feedback you voluntarily provide is deemed non-confidential, and SUHARA may use it without restriction or compensation to you.

Report abuse: if you encounter objectionable content or a violation of these Terms on the Site, report it to info@suharawears.com.

9. Force Majeure

SUHARA is not liable for delay or failure to perform where caused by events beyond its reasonable control — natural disasters, strikes, courier/logistics disruptions, government action, pandemics, internet/payment gateway outages, or other force majeure events.

10. Limitation of Liability

To the maximum extent permitted under Indian law, SUHARA's total liability for any order shall not exceed the amount you paid for that order. SUHARA is not liable for indirect, incidental, consequential, or special damages, including loss of profits or data, except where such liability cannot be excluded under the Consumer Protection Act, 2019 or other applicable law.

11. Disclaimer of Warranties

While we make reasonable efforts to ensure information on the Site is accurate, we do not warrant the completeness or accuracy of all data, information, or product descriptions. We are not liable for non-availability of the Site during maintenance, or unplanned suspensions due to technical reasons or events beyond our control.

12. Indemnity

You agree to indemnify and hold SUHARA harmless from any claim, loss, or demand, including reasonable legal fees, arising from your breach of these Terms, misuse of the Site, or violation of any law or third-party right.

13. Termination

We may suspend or terminate your access to the Site or any Service if we believe, acting reasonably, that you have breached these Terms, abused our policies, or engaged in fraudulent activity. You remain liable to pay for any product/service already ordered up to the point of termination; amounts already paid for undelivered goods will be refunded.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India
Disputes not resolved through the grievance mechanism will first be attempted amicably; failing which, referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually, seated in Surat, Gujarat, in English
Subject to the above, courts at Surat, Gujarat have exclusive jurisdiction
Nothing in this clause deprives you of your statutory right to approach the Consumer Commissions under the Consumer Protection Act, 2019

16. Severability

If any provision is held invalid or unenforceable by a court/arbitrator of competent jurisdiction, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions continue in full force.

17. Entire Agreement & Amendments

These Terms, together with the Privacy Policy, Return/Exchange/Refund Policy, Shipping Policy, and Grievance Handling Mechanism, constitute the entire agreement between you and SUHARA. We may revise these Terms at any time; the version in effect when you place an order governs that order. Material changes will be posted here with an updated "Last updated" date.
